Legal European Warranty
Caffè Borbone (Z.I. Località ASI Pascarola 80023 – Caivano (NA)) complies with the statutory warranty obligations provided under consumer law for all its products, including coffee and coffee machines:
- coffee products are warranted against defects until their expiry date;
- coffee machines are warranted against defects for a period of 2 years from the date of purchase.
In the event of defective products, Caffè Borbone will repair or replace the defective product. Where such primary remedies are not feasible, the Customer may request termination of the contract or a proportional reduction of the purchase price.
No warranty shall apply where the defect is caused by improper use or by the Customer’s fault.
Withdrawal
Right of Withdrawal
Consumers have the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires 14 days from the day on which the consumer or a third party designated by them (other than the carrier) acquires physical possession of the goods or, in the case of periodic delivery of goods, from the day on which physical possession of the first good was acquired.
To exercise the right of withdrawal, the consumer must inform the trader (Caffè Borbone S.r.l. – Z.I. Località ASI Pascarola 80023 – Caivano (NA)) of their decision to withdraw from the contract by means of an explicit statement. The consumer may also communicate their decision to withdraw electronically by following the instructions included in the section “Instructions for exercising the right of withdrawal”; in such case, the consumer will receive without undue delay an e-mail confirmation of receipt of the withdrawal. To meet the withdrawal deadline, it is sufficient for the consumer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
In the event of withdrawal, the consumer shall be reimbursed all payments made to the trader, including delivery costs (except for the supplementary costs resulting from the consumer’s choice of a type of delivery other than the least expensive standard delivery offered by the trader), without undue delay and in any event not later than 14 days from the day on which the trader is informed of the consumer’s decision to withdraw from the contract. Such reimbursement shall be made using the same means of payment used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise. In the case of cash on delivery payments to the courier, the refund shall be made by bank transfer to the bank details provided by the consumer to the trader. In any event, the consumer shall not incur any fees as a result of such reimbursement.
The consumer is requested to return the goods using the return label provided by the trader and following the shipping instructions supplied upon receipt of the withdrawal notice, without undue delay and in any event within 14 days from the day on which they communicated their withdrawal from the contract. The deadline is met if the consumer sends back the goods before the period of 14 days has expired. The cost of returning the goods shall be borne by the trader unless otherwise indicated in the contract. The consumer shall be liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
